Terms of Service

These Terms of Service (“Terms”) govern your use of mindmeldinteractive.com (the “Site”) and any consultations, services, digital products, or materials offered by MindMeld Interactive (“MindMeld Interactive,” “we,” “us,” or “our”). By using the Site or purchasing from us, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who we are

MindMeld Interactive is a digital operations and marketing consultancy based in North County San Diego, California. You can reach us at info@mindmeldinteractive.com or (760) 512-3762.

2. Using this site

You must be at least 18 years old to book services or purchase digital products.

Use the Site only for lawful purposes. Do not attempt to disrupt the Site, scrape it, reverse engineer it, or gain unauthorized access to it or the systems behind it.

We may update, suspend, or remove any part of the Site at any time without notice.

3. Services and signed agreements

Descriptions of our consulting, strategy, implementation, and maintenance work on the Site are for general information. Custom projects are governed by a separate signed Service Agreement and Scope of Work. If a signed agreement conflicts with these Terms, the signed agreement controls.

4. Bookings, payments, and pricing

Prices are listed in US dollars and may change at any time. The price shown when you book or purchase is the price that applies.

Payments are processed by third-party payment processors. We do not store full card numbers.

Sessions and assessments are paid in full before they take place unless we agree otherwise in writing.

5. Rescheduling and cancellations

You may reschedule a booked session with at least 24 hours’ notice. A session missed without notice may be forfeited. If we need to reschedule, we will offer you a new time or a refund for that session.

6. Refunds

Consultations and digital products deliver time and information right away, so fees are generally non-refundable once a session has taken place or a digital product has been accessed. If something is not right, contact us at info@mindmeldinteractive.com within 7 days of your purchase and we will work with you in good faith. Refunds for custom projects follow your signed agreement.

7. Digital products and assessments

When you purchase a digital product, workbook, template, or assessment, you receive a personal, non-transferable license to use it for your own business. You may not resell, redistribute, or publicly share it without our written permission.

8. Your responsibilities

Our recommendations depend on the information you give us. You are responsible for the accuracy of what you share, for having the rights to any materials you provide, and for the decisions you make about your business, including the tools, vendors, and spending you choose.

9. Intellectual property

The Site and its content, including text, graphics, logos, video, frameworks, and methods, belong to MindMeld Interactive or its licensors and are protected by copyright and trademark law. You may not copy or reuse them without our written permission. Ownership of work we create for clients is set out in each client’s signed agreement.

10. Third-party tools and affiliate links

We recommend and link to third-party platforms, such as hosting, scheduling, website, and software providers. Some of these are affiliate links, which means we may earn a commission at no extra cost to you. Third-party tools are governed by their own terms, and we are not responsible for their availability, pricing, or performance.

11. No guarantee of results

We bring our expertise and do our best work, but business outcomes depend on many factors outside our control. We do not guarantee specific results, such as revenue, leads, search rankings, or growth. Content on the Site is general information and is not legal, financial, tax, or medical advice.

12. Disclaimer of warranties

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law.

13. Limitation of liability

To the fullest extent permitted by law, MindMeld Interactive is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Site or our services. Our total liability for any claim is limited to the amount you paid us for the service or product that gave rise to the claim in the 12 months before the claim.

14. Indemnification

You agree to defend and hold harmless MindMeld Interactive from claims arising from your misuse of the Site, your breach of these Terms, or materials you provide to us.

15. Privacy

How we collect and use personal information is described in our Privacy Policy.

16. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Before filing a claim, you agree to contact us and try to resolve the dispute informally. Any legal action will be brought in the state or federal courts located in San Diego County, California.

17. Changes to these Terms

We may update these Terms from time to time. The effective date at the top of this page shows when they last changed. Using the Site after an update means you accept the revised Terms.
